Preamble and contents
This document sets forth the legal terms and informational notices governing the operation of, and access to, the website published under the domain fjore.pl (hereinafter the “Website”) by FJORE Anika Chojnacka. It comprises (i) the Privacy Policy, (ii) the Cookie Policy, (iii) the Terms of Use, (iv) the Information Notice concerning the contact form, and (v) the Imprint. The provisions hereof take effect on the date stated on the title page and remain binding until lawfully amended, superseded or withdrawn.
1.1 Definitions and references
- Controller
- FJORE Anika Chojnacka, conducting business activity under entry in the Central Register of Business Activity (CEIDG) of the Republic of Poland, with its registered place of business at ul. Akteona 5A, 80-299 Gdańsk, Republic of Poland, holding Tax Identification Number (NIP) PL 586 213 88 97 and Business Statistical Number (REGON) 380956356.
- GDPR
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
- Personal Data
- Has the meaning ascribed to it in Article 4(1) GDPR.
- Data Subject
- Any identified or identifiable natural person whose Personal Data are processed by the Controller in connection with the operation of the Website.
- Processing
- Has the meaning ascribed to it in Article 4(2) GDPR.
1.2 Identity and contact details of the Controller
The Controller may be contacted in all matters relating to the Processing of Personal Data by electronic mail addressed to office@fjore.pl or by postal correspondence delivered to the address specified in Section 1.1 above. The Controller has not appointed a Data Protection Officer, no such appointment being required by Article 37 GDPR in respect of the Controller's activities.
1.3 Categories of Personal Data processed
The Controller processes the following categories of Personal Data of the Data Subject:
- Identification and contact data voluntarily provided by the Data Subject by means of the contact form or by direct correspondence, including given name and surname, electronic mail address, telephone number, business affiliation, and the content of the communication addressed to the Controller.
- Technical data automatically collected through the operation of the Website, including Internet Protocol (IP) address, user-agent identifier, the pages of the Website accessed, the date and time of access, and the referring source, by means of server log files and cookies.
1.4 Purposes of Processing and legal bases
The Controller processes Personal Data exclusively for the purposes, on the legal bases and for the periods set forth in the table below:

1.5 Recipients of Personal Data
Personal Data may be disclosed exclusively to (i) processors engaged by the Controller for the purpose of providing hosting, electronic-mail, information-technology, accounting and web-analytics services, acting under written instructions of the Controller pursuant to Article 28 GDPR, and (ii) public authorities, where disclosure is required under the provisions of generally applicable law. The Controller does not transfer Personal Data to third parties for the purpose of their independent marketing activities and does not sell Personal Data.
1.6 Transfers to third countries
The Controller endeavours to ensure that Personal Data are processed within the European Economic Area (“EEA”). To the extent that any processor engaged by the Controller processes Personal Data in a country outside the EEA, including, in particular, the United States of America, such transfer shall take place exclusively on the basis of an appropriate safeguard within the meaning of Chapter V GDPR, in particular the Standard Contractual Clauses adopted by Commission Implementing Decision (EU) 2021/914 of 4 June 2021. A copy of the safeguard applied shall be made available to the Data Subject upon written request addressed to the Controller.
1.7 Rights of the Data Subject
The Data Subject shall be entitled to exercise, in accordance with and subject to the conditions laid down in the GDPR, the following rights:
- the right of access to Personal Data (Article 15 GDPR);
- the right to rectification of Personal Data (Article 16 GDPR);
- the right to erasure of Personal Data (Article 17 GDPR);
- the right to restriction of Processing (Article 18 GDPR);
- the right to data portability (Article 20 GDPR);
- the right to object to Processing carried out on the basis of Article 6(1)(f) GDPR (Article 21 GDPR); and
- the right to withdraw consent at any time, without affecting the lawfulness of Processing carried out on the basis of consent before its withdrawal (Article 7(3) GDPR).
The exercise of any of the foregoing rights shall be effected by means of a request addressed to the Controller at office@fjore.pl. Without prejudice to any other administrative or judicial remedy, the Data Subject shall further be entitled to lodge a complaint with the competent supervisory authority, namely the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warszawa, Poland (uodo.gov.pl).
1.8 Voluntariness of provision
The provision of Personal Data is voluntary. Failure to provide an electronic-mail address shall, however, render it impossible for the Controller to respond to the enquiry submitted by the Data Subject.
1.9 Automated decision-making and profiling
The Controller does not make decisions based solely on automated Processing of Personal Data, including profiling, which produce legal effects concerning the Data Subject or which similarly significantly affect him or her, within the meaning of Article 22 GDPR.
2.1 Legal basis
The storage of information, and access to information already stored, on the terminal equipment of the user of the Website is permitted on the conditions laid down in Article 173 of the Act of 16 July 2004 — Telecommunications Law (consolidated text), in conjunction with the relevant provisions of the GDPR and Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector.
2.2 Categories of cookies employed

2.3 Management of cookies by the user
The user may grant, refuse or withdraw consent to the use of non-essential cookies through the consent management mechanism displayed upon the user's first visit to the Website. Each commonly used web browser, in particular Google Chrome, Mozilla Firefox, Apple Safari and Microsoft Edge, further provides the user with the technical means to block or delete cookies; the user is referred to the respective help documentation of his or her browser for the relevant instructions.
3.1 Subject matter and acceptance
These Terms of Use (hereinafter the “Terms”) govern the access to, and use of, the Website by any person visiting it (hereinafter the “User”). By accessing or otherwise using the Website, the User acknowledges that he or she has read, understood and unconditionally accepted these Terms. A User who does not accept these Terms is requested to refrain from any use of the Website.
3.2 Nature of the Website; invitation to treat
The Website constitutes an informational and presentational publication concerning the Controller and the general scope of its professional activities. No goods or services are offered for sale, and no contract may be concluded, directly through the Website.
Express disclaimer. All information published on the Website, including, without limitation, descriptions of real-estate assets, mandates, market data and indicative commercial parameters, shall be construed as an invitation to enter into negotiations within the meaning of Article 71 of the Act of 23 April 1964 — Civil Code (consolidated text) (hereinafter the “Civil Code”) and shall not constitute an offer within the meaning of Article 66 § 1 of the Civil Code. No legally binding obligation of the Controller shall arise solely from the publication of any such information. Any engagement between the Controller and a prospective counterparty shall require a separate written agreement, duly executed by both parties.
3.3 Intellectual property rights
All content made available on the Website, including, without limitation, texts, graphic elements, photographs, layout, the FJORE word mark and any other distinctive signs, is protected by copyright pursuant to the Act of 4 February 1994 on Copyright and Related Rights (consolidated text), and by other applicable intellectual property rights, and constitutes the exclusive property of the Controller or of its licensors. The User is hereby granted a limited, non-exclusive and non-transferable licence to view and to print individual pages of the Website solely for his or her personal, non-commercial use. Any reproduction, redistribution, public communication, modification, adaptation or commercial exploitation of any content of the Website, in whole or in part, by any means and in any form, is prohibited save with the prior express written consent of the Controller.
3.4 No professional advice; limitation of liability
The information published on the Website is of a general and informational nature only. It does not constitute, and shall not be construed as, investment advice, legal advice, tax advice, financial advice or any other form of professional advice, and shall not serve as the sole basis for any decision having legal, financial or commercial consequences. The Controller shall not be required to update any information published on the Website and gives no representation or warranty, whether express or implied, as to the accuracy, completeness, currency or fitness for any particular purpose of such information.
To the maximum extent permitted by mandatory provisions of applicable law, the Controller shall not be liable for any damage, whether direct, indirect, incidental, consequential, punitive or otherwise, arising out of or in connection with (i) the use of, or the inability to use, the Website, (ii) reliance placed on any information published on the Website, or (iii) any interruption, error, defect, virus or other harmful component in connection with the Website. Nothing in these Terms shall exclude or limit the liability of the Controller in respect of damage caused intentionally or by gross negligence, or any other liability which cannot lawfully be excluded or limited.
3.5 Technical requirements
The proper functioning of the Website requires that the User dispose of (i) a device with active access to the public Internet network, (ii) a current and supported version of a standard web browser, and (iii) the activation, on the User's device, of JavaScript and of the cookies categorised as strictly necessary in Section 2.2.
3.6 Complaints
Any complaint relating to the operation of the Website shall be addressed to the Controller at office@fjore.pl and shall contain such information as is reasonably required to permit its examination, including the description of the issue and the contact details of the complainant. The Controller undertakes to consider the complaint and to communicate its position to the complainant within fourteen (14) days of its receipt.
3.7 Governing law and jurisdiction
These Terms shall be governed by, and construed in accordance with, the laws of the Republic of Poland. Any dispute arising out of or in connection with these Terms shall be referred to the Polish court having jurisdiction by virtue of generally applicable provisions of law. Where the User has the status of a consumer within the meaning of Article 22[1] of the Civil Code, the foregoing shall be without prejudice to any mandatory provisions of law affording him or her protection, including those relating to jurisdiction. The Controller hereby informs consumers of the existence of the European Commission's Online Dispute Resolution platform, accessible at ec.europa.eu/consumers/odr, established pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013.
3.8 Amendments
The Controller reserves the right to amend these Terms at any time. The amended version, together with the date from which it takes effect, shall be made available on the Website. The version applicable to any given use of the Website shall be that which is in force at the time of such use.
3.9 Severability
Should any provision of these Terms be held invalid, unlawful or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the parties shall replace the affected provision by a valid and enforceable provision which most closely reflects its original economic and legal intent.
Pursuant to Article 13 GDPR, the Controller hereby informs the Data Subject submitting an enquiry through the contact form, or by direct electronic-mail correspondence, of the following.

4.2 Legal basis, retention and rights
The legal basis for Processing shall be Article 6(1)(b) GDPR, namely the taking of steps at the request of the Data Subject prior to the conclusion of a contract. The retention period shall not exceed thirty-six (36) months from the date of last contact, save where a longer period is required for the establishment, exercise or defence of legal claims of the Controller. The full information notice, including the categories of recipients, transfers to third countries and the rights of the Data Subject, is set forth in Section 1 above (Privacy Policy).
